PropertyMarg is an online technology platform that enables users to publish and discover property listings.

PropertyMarg is not:

  • A real estate broker
  • A real estate agent
  • A property dealer
  • A property consultant
  • A legal advisor
  • A financial advisor
  • A mediator
  • A representative of buyers or sellers
  • A party to any property transaction

PropertyMarg merely provides a digital platform through which users can publish and view property listings.

3No Brokerage or Agency Relationship

Using PropertyMarg does not create any brokerage, agency, partnership, employment, fiduciary, representative, or joint venture relationship between PropertyMarg and any user.

PropertyMarg does not represent buyers, sellers, landlords, tenants, builders, brokers, or agents in any capacity.

4User-Generated Content

All property listings, descriptions, prices, photographs, ownership claims, amenities, locations, dimensions, documents, and related information are submitted by users.

PropertyMarg does not prepare, create, edit, or independently verify such information.

The person posting a listing is solely responsible for its legality, authenticity, completeness, and accuracy.

5No Verification or Endorsement

PropertyMarg does not verify, certify, guarantee, recommend, endorse, or approve:

  • Ownership of any property
  • Identity of any user
  • Legal title
  • Government approvals
  • RERA registration
  • Encumbrances
  • Pending litigation
  • Measurements
  • Pricing
  • Photographs
  • Amenities
  • Availability
  • Construction status
  • Tax status
  • Permissions
  • Uploaded documents
  • Any claim or representation contained in a listing

The appearance of a listing on PropertyMarg does not imply that PropertyMarg has verified or endorsed that property or the person posting it.

6Independent Due Diligence

Users must independently verify all information before buying, selling, renting, investing, negotiating, booking, or making any payment.

Users should independently verify, among other things:

  • Ownership documents
  • Identity of the concerned party
  • Legal title
  • Government approvals
  • Property condition
  • Site location
  • Pricing
  • Applicable permissions
  • Existing liabilities or disputes

Users are encouraged to seek independent legal, financial, or technical advice wherever appropriate.

7No Participation in Transactions

PropertyMarg does not:

  • Negotiate transactions
  • Mediate disputes
  • Execute agreements
  • Witness transactions
  • Hold funds
  • Accept token money
  • Accept booking amounts
  • Process payments
  • Operate escrow services
  • Guarantee completion of transactions

All negotiations and transactions occur solely between the concerned users.

8Payment Warning

Users should never transfer token money, booking amounts, advances, deposits, or any other payment solely based on information displayed on PropertyMarg.

Payments should only be made after proper independent verification and personal satisfaction.

PropertyMarg shall not be responsible for any financial loss, payment dispute, scam, or fraud arising from payments made between users.

9External Communications

Once users exchange phone numbers, WhatsApp messages, emails, or communicate outside the platform, PropertyMarg has no control over such interactions and bears no responsibility for them.

10User Responsibilities

Each user agrees to:

  • Provide truthful and accurate information.
  • Publish only content they are legally authorised to publish.
  • Ensure listings are not misleading.
  • Keep listings reasonably updated.
  • Remove unavailable properties where appropriate.
  • Comply with applicable laws and regulations.

11Prohibited Conduct

Users shall not:

  • Post fake listings.
  • Misrepresent ownership.
  • Upload forged or misleading documents.
  • Use false identities.
  • Impersonate others.
  • Publish fraudulent pricing.
  • Engage in scams.
  • Upload unlawful content.
  • Misuse the platform.

PropertyMarg reserves the right to remove listings or suspend accounts at its sole discretion.

12Fraud and Third-Party Conduct

PropertyMarg shall not be responsible for:

  • Fake listings
  • Fraudulent users
  • Identity fraud
  • Ownership disputes
  • Title disputes
  • Inheritance disputes
  • Boundary disputes
  • Encroachment issues
  • Forged documents
  • Payment scams
  • Misrepresentation
  • Duplicate listings
  • Financial losses
  • Litigation relating to listed properties
  • Any misconduct by third parties

Users interact entirely at their own risk.

13No Obligation to Pre-Screen

Although PropertyMarg may review or remove listings at its discretion, it is under no obligation to pre-screen, investigate, monitor, or verify every listing, user, or document before publication.

14No Warranty

The platform is provided on an “AS IS” and “AS AVAILABLE” basis.

PropertyMarg makes no warranty regarding:

  • Accuracy
  • Completeness
  • Reliability
  • Authenticity
  • Availability
  • Sale success
  • Rental success
  • Pricing
  • Response from users
  • Completion of transactions
  • Conduct of users

15No Professional Advice

Nothing available on PropertyMarg constitutes legal, financial, tax, investment, valuation, or professional advice.

Users should seek independent professional guidance wherever necessary.

16User Decisions

Every decision to purchase, rent, lease, sell, negotiate, invest, or make payments is taken solely at the user's own discretion and risk.

17Limitation of Liability

To the maximum extent permitted by applicable law, PropertyMarg and its owners, operators, employees, affiliates, and representatives shall not be liable for any direct, indirect, incidental, consequential, exemplary, special, financial, reputational, or punitive damages arising from:

  • Use of the platform
  • Reliance on listings
  • User interactions
  • Property transactions
  • Fraud
  • Payment disputes

  • Ownership disputes

18Indemnity

Users agree to indemnify and hold harmless PropertyMarg, its owners, employees, affiliates, and representatives against any claims, proceedings, liabilities, losses, damages, expenses, or costs arising from:

  • Their listings
  • Their conduct
  • Their transactions
  • Violation of these Terms
  • Violation of applicable laws

19Right to Remove Content

PropertyMarg may edit, reject, suspend, disable, or remove any listing, image, account, or content at any time, with or without notice, where it considers such action appropriate.

20Service Availability

PropertyMarg does not guarantee uninterrupted, secure, or error-free operation of the platform and may modify, suspend, or discontinue features at any time without prior notice.

21Cooperation with Lawful Authorities

Where required by applicable law or valid legal process, PropertyMarg may cooperate with competent authorities regarding suspected fraud, unlawful activities, or legal investigations.

22Intellectual Property

All PropertyMarg branding, logos, trademarks, website content, software, designs, and intellectual property remain the exclusive property of PropertyMarg unless expressly stated otherwise.

23Amendments

PropertyMarg may update these Terms & Conditions from time to time. Continued use of the platform after such updates constitutes acceptance of the revised Terms.

24Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.

Any dispute concerning the operation of the PropertyMarg platform shall be subject to the jurisdiction of the competent courts located in Sangli, Maharashtra.

Disputes solely between buyers, sellers, landlords, tenants, builders, brokers, agents, or other users shall remain exclusively between those parties, and PropertyMarg shall not be considered a party merely because a listing appeared on the platform.
